That question is best answered by Broadcom support. Broadcom participates in
the Partner Linux Driver Process
        http://developer.novell.com/wiki/index.php/Partner_Linux_Driver_Process_Introduction
which provides them with access to an infrastructure through which they can
build their drivers for our current kernels. Normally, drivers built through
this process are published by the partner in question, not by Novell.
